St. Charles County sued over rejected AT&T cell tower

ST. LOUIS - Parallel Towers III and Cellective Solutions filed a federal lawsuit on Jan. 20 in the Missouri Eastern District Court against St. Charles County over a rejected cell tower.

According to the lawsuit, the County of St. Charles improperly denied Plaintiff's application a conditional use permit to construct a telecommunication tower on a parcel of property near Highway D in Defiance. Plaintiffs sought to build this tower so that AT&T, the dominant carrier in the region, can economically provide enhanced 5G cellular services to the citizens of the county and first responders through the FirstNet network. 

Plaintiffs seek an order requiring the county to certify to this court a true, full and complete copy of the record of the acts and procedures involved in the denial of the application, an order prohibiting the county from denying the application, an order requiring the county complete a ministerial act of approving the application and an issuing of a writ of mandamus directing the county to discharge its duties properly and approve the application. Plaintiffs are represented by Eric D. Martin.
