Working from home was thrust upon most employees and employers alike at the onset of the COVID-19 pandemic. For many jobs, this proved surprisingly feasible, at least in the short-term. Before the pandemic shutdown, there had been a strong orientation toward in-person work and remote work as an ADA accommodation was often denied, but the shutdown called into question many of the assumptions underlying these denials.
Still, the fact remains that remote work is not necessarily reasonable or feasible for certain campus positions, particularly with the move back to in-person learning. On the other hand, institutional commitment to diversity, including the employment of individuals with disabilities, remains strong. And, of course, legal compliance remains imperative. How do we balance the various interests in evaluating remote work accommodation requests, and has anything changed?
This webinar will provide a brief overview of the history and relevant provisions of the ADA regarding remote work and legal developments since March 2020. We will also discuss practical considerations and best practices for institutions evaluating remote work accommodation requests.
