Woman sues St. Peters Subway store for alleged ADA violations

ST. LOUIS – A disabled woman has filed a lawsuit against a St. Peter's Subway restaurant claiming the establishment is not handicap accessible and violates the Americans with Disabilities Act.

Plaintiff Maryanne McCauley filed the lawsuit in federal court against ACA Properties citing violations of the Americans with Disabilities Act (ADA).

According to court documents, McCauley is a disabled individual who needs the use of a wheelchair for mobility. She is also an advocate for the rights of disabled individuals and acts as a "tester" to ensure compliance with the ADA. She claims that on September 22, 2023, she visited a St. Peters Subway sandwich restaurant owned and operated by the defendants. 

While on the premises, she says she observed several ADA violations, including non-compliant accessible parking spaces, improper accessible ramp slopes, violations of reach and height requirements, inadequate maneuvering clearance, and non-compliant restroom features, among others.

McCauley claims these violations prevent her from fully enjoying the goods, services and facilities offered at the property.

McCauley requests that the court issue a permanent injunction against ACA Properties to stop their discriminatory practices and to order them to modify the property to comply with ADA standards. Additionally, she seeks reimbursement for attorney's fees, court costs, legal expenses, and any other relief the court deems proper.
