St. Mary's Hospital accused of negligence and medical malpractice in wrongful death suit.

ST. LOUIS – An Illinois man has filed a wrongful death lawsuit against St. Mary's Hospital in St. Louis claiming his brother died as a result of negligence and medical malpractice.

Plaintiff Justin Roberson, as administrator of the Estate of Michael Steward, Jr. and individually, filed the lawsuit in federal court against SSM Health Care St. Louis, doing business as SSM Health St. Mary's Hospital-St. Louis, citing allegations of negligence and medical malpractice.

According to court documents, Roberson is the brother of Steward, who passed away April 12, 2019. Roberson says in March or April of 2019, Steward was a patient at St. Mary's Hospital for a urinary tract infection and respiratory problems. Roberson alleges his brother died as a result of the hospital and its employees' failure to take reasonable steps to monitor Steward's urinary tract infection and to prevent acute hypoxic respiratory failure. His complaint details specific instances of alleged negligence by nurses, including failures to report changes in Steward's condition, use correct equipment, and document communication to physicians.

Roberson is seeking damages for the loss of Steward's companionship, medical and funeral costs, and pecuniary damages, as well as Steward's pain, suffering, physical distress and death, plus court costs and any other relief the court deems proper. He is being represented by Michael G. Kelly of Kelly & Bracey Law Offices in Chicago.
