Missouri debt collection agency faces lawsuit for alleged violations of Telephone Consumer Protection Act

KANSAS CITY – A Texas resident has filed a lawsuit against a Missouri debt collection agency claiming the company violates the Telephone Consumer Protection Act by sending his phone number artificial prerecorded voice messages without his consent.

Plaintiff Rogelio Salinas filed the potential class action lawsuit November 2 in federal court against Dignity Collect, citing violations of the Telephone Consumer Protection Act.

According to court documents, the TCPA restricts the use of artificial or prerecorded voice calls, making it unlawful to make such calls to telephone numbers assigned to cellular telephone services without prior express consent.

Since June 2023, Salinas claims Dignity Collect has violated the TCPA by regularly sending artificial and prerecorded voice messages to his cell phone number. Salinas claims he spoke to representatives from Dignity Collect, who told him they're trying to contact Sherry Reed Holmes. He said he's told Dignity Collect representatives they have the wrong phone number and to stop contacting him, but the messages have continued.

The complaint claims these actions have caused Salinas harm, including invasion of privacy, intrusion into his life and annoyance. The lawsuit seeks class-action certification to represent individuals throughout the U.S. who received similar calls from Dignity Collect.

Salinas is seeking damages, interest, attorney fees, court costs and other relief.
