Class action claims H&M misrepresents products as environmentally friendly

Federal Court
O judge

judge gavel 1280

A potential federal class action lawsuit accuses H&M of intentionally misleading consumers into believing some of its products are environmentally friendly when they are not.

Randall Sally is the named plaintiff in the lawsuit filed in federal court against H&M or Hennes & Mauritz. He represents a class of persons who purchased H&M products for personal, family or household purposes

According to the complaint, H&M has engaged in unlawful, unfair, deceptive and misleading business practices concerning the marketing and sale of their products. It focuses on H&M's claim that certain clothing products are made with recycled and/or organic materials when, according to the lawsuit, these products actually are made with virgin synthetic, conventionally grown and/or non-organic materials.

The complaint says this misrepresentation deceives consumers into believing they are purchasing environmentally friendly products when they are not.

The complaint further alleges that H&M knowingly capitalized on consumer trends towards "green" products and that he would not have purchased the products had he known they were not made with recycled or organic materials. The lawsuit seeks to remedy these alleged deceptive practices by H&M.
