Couple sues Walmart for slip-and-fall injury

ST. LOUIS — A Missouri couple is suing Walmart alleging injuries while they were near the self-checkout of one of its stores.

Joni T. Allard and Robert C. Allard Jr. were at Walmart on July 10, 2022, when Joni Allard encountered a hazardous situation on the premises, according to a complaint filed Nov. 21 in U.S. District Court for the Eastern District of Missouri.

The Allards claim there was a wet and slippery substance on the floor near the self-checkout area, which led to Jone Allard slipping, falling and sustaining physical injuries.

The Allards claim Joni Allard was an invitee at Walmart Store #2213.

Due to her fall on the dangerous condition, Joni Allard suffered comminuted distal radius and ulnar fractures of her left wrist and forearm, as well as a comminuted distal radius fracture and a non-displaced ulnar styloid process fracture of her right wrist, according to the suit.

Jone Allard underwent several surgical procedures, including an open reduction and internal fixation to address the left distal radius fracture, an open reduction and internal fixation of the left ulnar shaft, an open reduction and internal fixation of the right distal radius fracture, a closed reduction and percutaneous pinning of the left distal radioulnar joint and physical rehabilitation and therapy.

The Allards are seeking compensatory damages in excess of $75,000. They are represented by Michael S. Hamlin of Nichols Lang & Hamlin in Chesterfield.
