Parent sue school district over special education decision

A school district is being sued by parents who seek to reverse a special education decision they say was dismissed without a due process hearing.

Jon and Amanda Brown, as parents of a student identified only as C.B., filed the lawsuit in federal court against Grain Valley R-V School District.

The Browns accuse the school district of failing to provide their son with a free and appropriate public education. They claim the district failed to properly evaluate their son, develop an adequate Individualized Education Program, provide essential services, follow parental safeguards under the Individuals with Disabilities Education Act, consider parental input and discriminated against their son based on his disability.

C.B., who has Noonan Syndrome and other health impairments, is enrolled in Horizon Academy, a private school specializing in children with dyslexia. The lawsuit claims the school district's failure dates back to January 2021 during C.B.'s third-grade year. After exhausting administrative remedies with the Missouri Administrative Hearing Commission in June 2023, the Browns took their case to court following the dismissal of their Due Process Petition in August 2023.
