A travel nurse is accusing a company of violating the Americans with Disabilities Act.
Marci Caudill filed her complaint in federal court against Trustaff Travel Nurses.
According to the complaint, Caudill applied for a position as a travel nurse with Trustaff in December 2022 and was accepted to start work on January 9, 2023. However, before her employment commenced, Trustaff discovered Caudill had a pending charge for possession of methamphetamine. Despite not being found guilty or pleading guilty to the charge at the time and not illicitly using or addicted to controlled substances, Trustaff decided not to employ Caudill.
Caudill says Trustaff declined her employment based on an erroneous belief she was using or addicted to controlled substances. She claims this action has caused her damage. Following this incident, Caudill filed a Charge of Discrimination with the Missouri Commission on Human Rights and EEOC on January 24, 2023. She received a Notice of Right to Sue from the EEOC on September 11, 2023.
Caudill is seeking judgment against Trustaff for damages including back and front pay, emotional distress, attorney fees and costs.
