A pharmacy has sued a pharmacy benefit management company for allegedly wrongfully terminating its network participation.
SPRX Inc. doing business as InjuryScripts filed its federal complaint against Express Scripts.
The suit was filed in response to Express Scripts' decision to terminate InjuryScripts from network participation effective December 15, 2023. Express Scripts justified the termination by saying InjuryScripts failed to disclose certain information related to a previous qui tam case brought by the Department of Justice against InjuryScripts' owners and two other pharmacies they own.
However, InjuryScripts claims Express Scripts was aware of the qui tam matter and its underlying allegations as early as May 2019, prior to issuing the termination letter. The plaintiff says this makes Express Scripts' allegations inaccurate and its conduct retaliatory, which is prohibited under agreement and applicable law. Consequently, InjuryScripts is seeking an injunction to prevent termination.
