Brothers accuse company of keeping tips meant for barbacks

Two brothers say a Kansas City company unlawfully retained tips meant for them.

Brad and Brent Bruders filed their complaint in federal court against KC Concessionaire.

According to the complaint, the company violated the Fair Labor Standards Act of 1938 and Missouri law by unlawfully retaining tips meant for the plaintiffs. The brothers were employed as barbacks at the defendant's entertainment venues in Jackson County, Missouri.

The complaint says an agreement was in place to remit 20 percent of all tips received from bar patrons to the plaintiffs. However, the brothers say KC Concessionaire wrongfully retained these tips. In addition, when the plaintiffs complained about this issue, they claim to have faced retaliation including physical assault on Brad Bruders by a manager which resulted in injuries.

The Bruders are seeking recovery of unpaid tips, actual and statutory damages, attorney fees and costs.
