Man files discrimination lawsuit against Frito Lay

A man has accused Frito-Lay of disability discrimination and retaliatory practices.

Mark V. Graf filed his complaint in federal court against Frito-Lay Inc. and Rolling Frito-Lay Sales LP alleging employment discrimination on the basis of disability and retaliation under the provisions of the Americans with Disabilities Act of 1990 and the ADA Amendments Act of 2008.

According to the complaint, Graf was employed by the defendants from July 27, 2001, until July 13, 2019. He says he suffered a severe injury to his left upper extremity and shoulder while working for the defendants in October 2014. Despite being able to perform his job duties with reasonable accommodation following surgery, Graf says his requests for accommodations were denied.

After returning to work in March 2015 with physical restrictions, Graf claims his job description was changed to include different physical requirements. When he requested reasonable accommodation for these new requirements, Graf alleges it was refused by the defendants. Consequently, Graf claims he was terminated from his job in September 2015 in violation of disability laws.

Graf also accuses Frito-Lay of paying him at a lower rate due to his disability upon his return to work in March 2015.
