A New York-based pharmacy claims Express Scripts Inc. and Medco Health Solutions Inc. breached their contract.
LO NG Pharmacy Corp., operating as Victoria Pharmacy, filed its complaint in federal court in Missouri.
According to the complaint, the dispute arises from an agreement made between Victoria Pharmacy and Express Scripts in 2019. The latest version of this agreement was entered into on November 22, 2023.
Victoria Pharmacy calls itself a small neighborhood pharmacy that serves hundreds of Express patients who often spend thousands of dollars annually on prescriptions. If these customers were to stop visiting because of the contract termination with Express Scripts, the pharmacy says it would significantly impact its sales.
Express Scripts is a Pharmacy Benefits Manager that administers and manages prescription drug programs on behalf of its clients. To fulfill its service obligations, Express uses various pharmacy networks including Victoria Pharmacy.
