Man says employer discriminated against him because of Huntington's Disease

A man is accusing Midwest Respiratory Care of discriminating against him because he has Huntington's Disease.

Ian Smith filed his lawsuit in federal court against Midwest Respiratory Care, Inc.

According to the complaint, Smith began working for Midwest Respiratory Care in 2020 as a Service Technician/Driver.

Smith claims his rights under the Americans with Disabilities Act (ADA) and/or the Missouri Human Rights Act (MHRA) were violated when Nebraska-based Midwest Respiratory Care discriminated against him because of his medical condition.

Smith says he previously has filed a Charge of Discrimination with both the Missouri Commission on Human Rights (MCHR) and the Equal Employment Opportunities Commission (EEOC). He received Right to Sue Notices from both organizations in late November and early December 2023, respectively.
