ST. LOUIS — A Missouri consumer is suing a Decatur, Illinois, debt collector and its lawyer, citing alleged tortious and illicit collection conduct.
Rebecca Haithcoat filed a complaint on March 17 in the U.S. District Court for the Eastern District of Missouri against Heavner, Beyers & Mihlar LLC and Faiq Mihlar, alleging that they violated the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that the defendants' conduct caused her to suffer statutory damages of $1,000, lost wages for appearing trials, expenses in legal pleadings, anxiety and frustration. The plaintiff holds the defendants responsible because they allegedly misrepresented the principal balance on the alleged debt and that the court costs and attorney's fees were already due.
The plaintiff requests a trial by jury and seeks actual and statutory damages, costs and reasonable attorney’s fees and such other relief as the court may deem just and proper. She is represented by Bryan E. Brody and Alexander J. Cornwell of Brody & Cornwell in St Louis.
