Karaoke accompaniment provider alleges Kirkwood restaurant, karaoke operators violated trademarks

ST. LOUIS — A karaoke accompaniment provider is suing a Kirkwood restaurant and karaoke providers, citing alleged unfair competition.

Phoenix Entertainment Partners LLC filed a complaint on March 17 in the U.S. District Court for the Eastern District of Missouri against Sportstime Inc., d/b/a Mike Duffy's Pub & Grill; Pro Source Entertainment Inc.; and James Allen alleging that they violated the Trademark Act.

According to the complaint, the plaintiff alleges that as a result of the defendants' unlawful activities, the plaintiff has been damaged through the loss of revenues and loss of its ability to control the quality of karaoke services provided. The plaintiff holds the defendants responsible because they allegedly used the plaintiff's federally registered Sound Choice service marks without authorization and did not take advantage of plaintiff's Safe Harbor program.

The plaintiff seeks an award for damages of not less than $50,000 per defendant, costs of suit and attorney’s fees and such other and further relief as justice may require. It is represented by Keith A. Vogt of The Law Office of Keith A. Vogt in Oak Park, Illinois.
