St. Louis County woman alleges New York debt collectors used unlawful collection practices

ST. LOUIS — A St. Louis County woman is suing New York debt collectors, citing alleged deceptive and misleading representations.

Diana Kelley filed a complaint on March 20, in the U.S. District Court for the Eastern District of Missouri against American Medical Collection Agency and Does 1-4 alleging that they violated the Fair Debt Collections Practices Act.

According to the complaint, the plaintiff alleges that on Oct. 24, she received an initial collection letter from the defendant, attempting to collect a debt for Quest Diagnostics Inc. totaling $184.99. The defendant's actions caused Kelley to suffer damages for time spent, consultation fees, humiliation, anxiety and embarrassment. The plaintiff holds the defendants responsible because they allegedly falsely threatened to report derogatory information about her credit to credit reporting agencies.

The plaintiff requests a trial by jury and seeks statutory damages of $1,000, actual damages, interest, costs and attorneys’ fees and such other or further relief. She is represented by Nathan D. Sturycz of Main Street Law in Edwardsville, Illinois.
