ST. LOUIS — A St. Louis County resident is suing debt collectors, citing alleged unlawful collection practices.
Stephen Kelley filed a complaint on March 22 in the U.S. District Court for the Eastern District of Missouri against Medicredit Inc. and Does 1-4, alleging that they violated the Fair Debt Collections Practices Act.
According to the complaint, the plaintiff alleges that on March 23, 2016, he received a collection and threatening letter from the defendant, which caused him to suffer damages in the form loss of time and attorneys’ fees paid for advice regarding his situation. He has also suffered shame, humiliation, anger, anxiety and fear. The plaintiff holds Medicredit and Does 1-4 responsible because the defendants allegedly threatened him of legal action, garnishment of wages and attachment or seizure of his bank account.
The plaintiff requests a trial by jury and seeks statutory damages of $1,000, actual damages, interest, costs, attorneys’ fees and such other or further relief as the court deems just and proper. He is represented by Nathan D. Sturycz of Main Street Law in Edwardsville, Illinois
