Consumer alleges Medicredit invaded privacy

ST. LOUIS — A consumer is suing Medicredit Inc., citing alleged violation of telephone harassment statutes.

Floyd Kinslow filed a complaint on March 22 in the U.S. District Court for the Eastern District of Missouri against Medicredit, alleging that the debt collector violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that on May 2016, he began receiving calls to his cellphone from the defendant. Such calls directly interfered with his right to peacefully enjoy a service he paid for and caused him to suffer anxiety, frustration and annoyance. The plaintiff holds Medicredit responsible because the defendant allegedly made calls using an automatic telephone dialing system and without his prior express consent.

The plaintiff requests a trial by jury and seeks statutory damages of $500 and treble damages for each TCPA violation and such other and further relief that this Court may deem just and proper. He is represented by Sergei Lemberg of Lemberg Law LLC in Wilton, Connecticut.
