Employee groups say Mark's Services failed to make contributions to funds

ST. LOUIS — Employee groups are suing Mark’s Services LLC, citing alleged violation of workers compensation acts.

Local 513, International Union of Operating Engineers, AFL-CIO, Local Union 513 Pension Fund, et al filed a complaint on March 23 in the U.S. District Court for the Eastern District of Missouri against Mark’s Services LLC alleging that the employer violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they are suffering and will continue to suffer immediate and irreconcilable injury and damage unless the defendant is ordered to perform all of its obligations and to pay the required contributions and ancillary amounts to the plaintiffs' funds. The plaintiffs hold Mark’s Services responsible because the defendant allegedly failed to timely submit reports of hours worked by its employees covered by the collective bargaining agreement, along with financial contributions.

The plaintiffs seek an order awarding all delinquent contributions and requiring the defendant to submit its records to an audit, as well as liquidated damages, interest, costs of court and such further relief as the court deems proper. They are represented by James P. Faul of Hartnett Gladney Hetterman LLC in St. Louis.
