James Hardie Building allegedly made defective siding components

ST. LOUIS — A consumer has filed a class-action lawsuit against James Hardie Building Products Inc., citing alleged fraudulent concealment.

Oren Pollock, individually and on behalf of all others similarly situated filed a complaint on March 28 in the U.S. District Court for the Eastern District of Missouri against James Hardie Building Products alleging that the building materials manufacturer violated the Missouri Merchandising Practices Act.

According to the complaint, the plaintiff alleges that due to the deterioration of the defendant's siding components, he has suffered damages for maintenance expenses, premature repair and replacement. The plaintiff holds James Hardie Building Products responsible because the defendant allegedly defectively manufactured, distributed, marketed and sold the sliding components and failed to fully repair damages caused by premature deterioration of the siding.

The plaintiff requests a trial by jury and seeks monetary damages in excess of $5 million, attorney fees, costs, and disbursements and any other relief as the court deems just and equitable. He is represented by R. Seth Crompton and Eric D. Holland of Holland Law Firm in St. Louis.
