ST. LOUIS — The acting secretary of labor for the U.S. Department of Labor is suing a St. Louis tavern, citing alleged violation of workers compensation acts.
Edward Hugler filed a complaint on March 29 in the U.S. District Court for the Eastern District of Missouri against Zesty Enterprise LLC, d/b/a Three Flags Tavern; Cathy O'Brien; and John O'Brien, alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between June 22, 2014, and June 21, 2016, as a result defendants violations of the act, the defendants' present and former employees suffered damages for not receiving proper overtime compensation for all hours worked over 40 per workweek.
The plaintiff holds the defendants responsible because they allegedly employed certain employees for workweeks longer than 40 hours without compensating them for their employment in excess of 40 hours per weeks at rates not less than 1.5 times the regular rates.
The plaintiff requests a trial by jury and seeks recover unpaid overtime compensation owing for defendant's’ employees, an additional amount as liquidated damages and post-judgment interest. He is represented by Laura M. O’Reilly of U.S. Department of Labor in Kansas City.
