Retiree claims St. Louis Teamster Brewery Workers Pension Plan underpayed benefits

ST. LOUIS — A retired employee is suing a pension plan and its trustees, citing alleged violation of workers compensation acts.

Hunter R. Levi filed a complaint on March 30, in the U.S. District Court for the Eastern District of Missouri against St. Louis Teamster Brewery Workers Pension Plan and St. Louis Teamster Brewery Workers Pension Plan Trustees alleging that they violated the provisions of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that as a result of defendants' actions, he has been damaged for receiving a lower monthly pension benefit. Had the defendants applied plan language to his employment history, his monthly benefit would have more than tripled from the initial payment. The plaintiff holds the defendants responsible because they allegedly denied the plaintiff's increase multiplier and service compensation and treated his pension as a deferred vested pension.

The plaintiff requests a trial by jury and seeks an order to increase his pension to $3,176.16 per month and to pay back benefits of $2,163.97 per month, plus interest.
