ST. LOUIS — Trustee representatives are suing Frontenac Painting Inc. and Charles R. Chernick for alleged violation of workers compensation acts.
Painters District Council No. 58, St. Louis Painters Pension Trust, St. Louis Painters Vacation Trust, et al filed a complaint on April 10 in the U.S. District Court for the Eastern District of Missouri against the defendants alleging that they violated the Employee Retirement Income Security Act (ERISA).
According to the complaint, the plaintiffs allege that they failed to receive an accurate amount owed to them by the defendant under an agreement and ERISA. This was due to missing weekly reports necessary to determine hours, work done and contributions owed to its bargaining unit employees at the rate and manner specified in the collective bargaining agreement and trust documents.
The plaintiffs holds Frontenac Painting and Chernick responsible because the defendants allegedly failed to submit weekly reports and contributions on all bargaining unit employees, failed to remit union dues to the painters and failed to file reports evidencing all hours worked of employees.
The plaintiffs request a trial by jury and seek all reports and payments to be submitted within seven days after each weekly payroll date, reasonable attorneys' fees, costs and such other further relief as the court may deems just and proper.
