CMT Roofing didn't contribute to pension and education plans, suit claims

ST. LOUIS — Trustee representatives are suing CMT Roofing LLC for alleged violation of workers compensation acts.

National Roofing Industry Pension Plan, Roofers and Waterproofers Research and Education Joint Trust Fund and Kinsey Robinson filed a complaint on April 10 in the U.S. District Court for the Eastern District of Missouri against the defendant alleging that they violated the Employee Retirement Income Security Act (ERISA).

According to the complaint, the plaintiffs allege that they failed to receive monthly contributions to the pension plan and education plan based on the numbers of hours worked by employees who are covered by the collective bargaining agreement.

The plaintiffs holds CMT Roofing responsible because the defendant allegedly failed to make monthly written reports covering number of hours worked and amounts payable to the pension and eduction plan and failed to pay principal contributions to the pension and education plan as required under ERISA.

The plaintiffs seek all payments in an amount to be proven for unpaid and delinquent contributions, attorneys' fees, costs and other relief that the court may deems just and proper. They are represented by James P. Faul of Hartnett Gladney Hetterman LLC in St. Louis.
