Amcol Systems allegedly told woman wages would be garnished even though it hadn't sued for debt

ST. LOUIS — A consumer is suing Amcol Systems Inc. and Does 1-4 for alleged misrepresentation in debt collection.

Loddie Gillespie filed a complaint on April 13 in the U.S. District Court for the Eastern District of Missouri against the defendants alleging that they violated the Fair Debt Collection Practices Act (FDCPA).

According to the complaint, the plaintiff alleges that on Oct. 11, the defendant sent plaintiff a collection letter attempting to collect an alleged debt from a medical service purchase amounting to $283.40. Plaintiff claims that during a phone call with the defendant in March, she was led to believe her wages would be garnished if she did not comply. The company allegedly said it did not intend to sue.

As a result, Gillespie claims she suffered shame, fear and emotional distress. 

The plaintiff holds the defendants responsible because they allegedly threatened and intimidated plaintiff by attempting to take legal action and garnishment of employment if plaintiff did not comply even though it was not permitted by law.

The plaintiff requests a trial by jury and seeks judgment for statutory damages of $1,000, actual damages, pre and post-judgment interest, costs, attorneys' fees and other relief as the court deems just and proper. She is represented by Nathan D. Sturycz in Edwardsville, Illinois.
