Hillsboro resident claims debt collector failed to identify original creditor

ST. LOUIS — A Hillsboro woman is suing a debt collector, citing alleged misrepresentation in debt collection.

Mary Hoyt filed a complaint on April 19, in the U.S. District Court for the Eastern District of Missouri against NCC Business Services Inc. alleging that the defendant violated the Fair Debt Collection Practices Act (FDCPA).

According to the complaint, the plaintiff alleges that on April 21, 2016, the defendant attempted to collect an alleged debt owed to Synchrony Bank. The defendant sent an initial validation letter. The plaintiff alleges the letter failed to identify the creditor to whom the debt is owed, which caused her to be unsure if the current creditor was Synchrony Bank, NCC Business Services or another third party. As a result, Hoyt claims she suffered emotional, mental pain and anguish. 

The plaintiff holds NCC Business Services responsible because the defendant allegedly failed to clearly and accurately identify the name of creditor to whom the debt is owed and failed to adequately review its actions to ensure compliance with the laws.

The plaintiff seeks judgment in the sum of $10,000 for actual and statutory damages, award for costs, attorneys' fees, and other relief as may be just and proper. She is represented by Stuart D. Werbin of Law Offices of Stuart Werbin in Brooklyn, New York.
