Couple alleges Speed Sport Automotive failed to warn of rotten roof, causing man to fall through

ST. LOUIS — Husband and wife are suing a property owner, citing alleged insufficient measures were taken to prevent injuries.

Kevin Potts and Bonnie Potts filed a complaint on April 27 in the U.S. District Court for the Eastern District of Missouri against Daryl Cooper, d/b/a Speed Sport Automotive, alleging that the property owner failed to provide safety equipment and/or netting.

According to the complaint, the plaintiffs allege that on Sept. 16, 2015, Kevin Potts was invited to inspect and replace the flat roof of defendant's property. As he started to peel the roof covering, he fell through it. As a result, he suffered catastrophic injuries that caused him to lose more than $100,000 in wages and incurred medical bills in excess of $100,000. Bonnie Potts suffered loss of consortium, services and companionship of her husband. The plaintiffs holds the defendant responsible because he allegedly failed to properly maintain the flat roof over the property and did not warn Kevin Potts that the roof was leaking, rotten and unstable.

The plaintiffs request a trial by jury and seek judgment in their favor in an amount that exceeds $75,000 and for all other and further relief that the court deems proper. They are represented by Richard A. Voytas Jr. and Nathan E. Ross of Ross & Voytas LLC in Ellisville.
