Former Central Contracting and Marine employees allege company failed to pay overtime wages

ST. LOUIS — Former employees are suing the owner of transportation company, citing alleged violation of workers compensation acts.

Jerrad Bourbon, William W. Fadler and Scott Hall filed a complaint May 1 in the U.S. District Court for the Eastern District of Missouri against Central Contracting and Marine Inc. and David Brown alleging that the defendants violated the Fair Labor Standards Act (FLSA) and Missouri Minimum Wage Law (MMWL).

According to the complaint, the plaintiffs allege that in 2016, they were employed as a non-exempt employee and were paid on an hourly rate basis by the defendant. The plaintiffs claim they frequently worked in excess of 40 hours per week but failed to receive overtime compensation for all time worked in excess of 40 hours in each workweek for three years. 

The plaintiffs hold Central Contracting and Marine and Brown responsible because they allegedly failed to pay the plaintiffs 1.5 times the regular rate of pay for all times worked over 40 hours in a workweek.

The plaintiffs request a trial by jury and seek payment for back pay overtime damages, liquidated damages, litigation costs, expenses, attorneys' fees, pre- and post-judgment interest, and such other and further relief as the court deems just and proper.
