Life Insurance Company of America is accused of breach of contract

ST. LOUIS — An woman is suing a life insurance company, citing alleged breach of contract by refusing to pay insurance benefits.

Janie Madison filed a complaint on May 3 in the U.S. District Court for the Eastern District of Missouri Eastern Division against Life Insurance Company of North America, doing business as Cigna, alleging that the defendant violated the Employee Retirement Income Security Act of 1974 (ERISA).

According to the complaint, the plaintiff alleges that as a beneficiary under the terms of a long-term disability insurance issued by the defendant to her employer, BJC Health System, she failed to receive payment of her benefits when she became disabled. 

The plaintiff holds the defendant responsible because it allegedly failed to provide specific reasons on why she was denied of her claims and failed to comply with the requirements under ERISA that a denial of claim should be given full and fair review to set forth specific reasons for such denial.

The plaintiff seeks payment under the long term disability policy, plus interest, attorney's fees, and other relief to which the court deems just. She is represented by Russell C. Still of Harlan, Harlan and Still in Columbia.
