ST. LOUIS — Trustees are suing a construction company, citing alleged violation of workers' compensation acts.
Kansas City Carpenters Regional Council and Renee Bell, Ken Stricker, Robert Calhoun, et al. filed a complaint on May 16 in the U.S. District Court for the Eastern District of Missouri Eastern Division against Jeff Butzinger Construction Inc. alleging that the defendant violated the Employee Retirement Income Security Act (ERISA).
According to the complaint, the plaintiffs allege that they have failed to receive an accurate amount owed to them by the defendant under the pension trust, the welfare trust and the vacation trust. This is allegedly due to missing monthly statements showing the total number of regular and overtime hours worked and delinquent contributions as specified in the collective bargaining agreement and trust documents.
The plaintiffs hold Jeff Butzinger Construction responsible because the defendant allegedly failed and refused to submit complete and accurate reports, failed and refused to make all obligated contributions to the funds and failed to forward all of the deducted dues to the union.
The plaintiffs seek payment for delinquent contributions, plus liquidated damages and interest, attorney's fees, costs of court and such additional relief as the court may deem just and proper. They are represented by Greg A. Campbell of Hammond and Shinners PC in St. Louis.
