ST. LOUIS — A board service attendant is suing a railroad corporation, citing alleged negligence in keeping the workplace safe for employees.
Victor Adzaku filed a complaint on May 13 in the St. Louis Circuit Court against National Railroad Passenger Corp. (Amtrak) alleging that the defendant violated the Federal Employer's Liability Act.
According to the complaint, the plaintiff alleges that starting on Dec. 3, 1998, as an employee of the defendant, the plaintiff sustained injuries while performing his duties. Adzaku claims he suffered severe physical injuries due to repetitive and cumulative motions, was violently shaken within the car he was working and was subjected to excessive lateral motion due to defective passenger cars and/or defective track.
The plaintiff holds the defendant responsible because it allegedly failed to provide a reasonably safe place to work, failed to properly maintain, repair or inspect the track in which it operated trains, failed to provide adequate help and failed to warn employees of the risks of repetitive trauma in the workplace.
The plaintiff requests a trial by jury and seeks judgment for a sum in excess of $25,000, together with costs expended and any other relief to which he may be entitled. He is represented by D. Matthew Dreesen of Dreesen Law Firm LLC in Chesterfield.
