Woman claims Compass Group terminated her employment due to age, disability

ST. LOUIS — A director of food and nutrition services is suing her former employer, citing alleged wrongful termination due to age and disability discrimination.

Marilyn Wilson filed a complaint on May 19 in the St. Louis Circuit Court against Compass Group USA Inc., Michael Bartula and Brandy Stephen, alleging that the defendants violated the Missouri Human Rights Act.

According to the complaint, the plaintiff alleges that on Sept. 20, 2015, her employment was terminated due to her age of 62 years old and disability of being an insulin-dependant diabetic. Before her termination, the defendants, without warning, placed her on a performance improvement plan (PIP) and gave her one month to comply with the PIP or be terminated. Wilson was informed that she had not completed the PIP and was terminated and allegedly replaced with a younger employee. As a result, Wilson claims she suffered a loss of wages and benefits of employment. 

The plaintiff holds Compass Group USA, Bartula and Stephen responsible because the defendants allegedly failed to notify plaintiff before conducting a PIP survey, disclosed the mandatory disability survey that should be confidential and terminated plaintiff because of her age and disability.

The plaintiff requests a trial by jury and seeks payment for damages, reinstatement to her former position, award for costs of the action, attorneys' fees, and such other and additional relief as the court may deem equitable and just.
