ST. LOUIS — A husband and wife are suing a residential property seller, citing alleged breach of contract.
Kevin J. Rosapep and Maria P. Rosapep filed a complaint on May 24 in the St. Louis Circuit Court against Shaw Holding Group LLC alleging that the residential property seller breached the implied covenant of good faith and fair dealing.
According to the complaint, the plaintiffs allege that on April 10, they deposited $3,000 in earnest money to the defendant for the purchase of a property in St. Louis, but the parties were unable to agree on the terms set forth in the inspection notice. As a result, the plaintiffs were damaged for not getting back their deposit.
The plaintiffs hold Shaw Holding Group responsible because the defendant allegedly failed and refused to release the plaintiffs from their obligations under the contract and the return the $3,000.
The plaintiffs request a trial by jury and seek an order declaring that the parties contract was terminated and that defendant should release the $3,000 held in escrow and all other relief as the court deems proper.
