Traders Point Farm Organics accused of misleading consumers

ST. LOUIS — A St. Louis consumer has filed a class-action lawsuit against a manufacturer of organic products, citing alleged fraud and unjust enrichment.

Nancy Albright, individually and on behalf of all other similarly situated citizens of Missouri, filed a complaint on May 26 in the St. Louis Circuit Court against Traders Point Farm Organics Inc., alleging that the defendant violated the Missouri's Merchandising Practices Act.

According to the complaint, the plaintiffs allege that the defendant listed evaporated cane juice as an ingredient in its products, which acts as a sweetener. However, the plaintiff and other consumers discovered, through the Food and Drug Administration, that evaporated cane juice is a sugar rather than a juice. The labels of the products allegedly created a false impression to mislead consumers that the products contain less sugar and can be sold for a higher price. 

The plaintiffs hold Traders Point Farm Organics responsible because the defendant allegedly failed to disclose the correct ingredient in its products, misled consumers into believing the products contains less sugar than they actually contain and charged plaintiff and class members a high price due to false information that the products contain evaporated cane juice.

The plaintiffs request a trial by jury and seek award for compensatory damages, pre and post-judgement interest, attorneys' fees, costs and such other further relief as may be just and proper. They are represented by Matthew H. Armstrong of Armstrong Law Firm LLC in St. Louis.
