Personal representative, beneficiary accuses Ste. Genevieve officers of wrongful death

CAPE GIRARDEAU — A personal representative and beneficiary are suing law enforcement officers, citing alleged deprivation of life, liberty and due process of law.

Daniel Breigel and Lynn Marie Rainey filed a complaint June 2 in the U.S. District Court for the Eastern District of Missouri Southeastern Division against Ste. Genevieve County, Deputy Cpl. Andrew Johnson, Deputy Cpl. Dustin R. Edwards and Deputy Cpl. Kristen Carrow, et al, alleging that they violated the Eighth and 14th Amendments to the U.S. Constitution.

According to the complaint, the plaintiffs allege that on March 4, 2016, the plaintiffs' decedent Marty Lynn Rainey was processed, incarcerated and was placed in extreme isolation. On March 25, 2016, he hung himself with a bed sheet. Marty Lynn Rainey allegedly suffered great physical anguish during both his incarceration and during his strangulation. The plaintiffs claim they have lost the care, services, comfort and support of Marty Lynn Rainey. 

The plaintiffs hold the defendants responsible because they allegedly failed to adequately assess decedent's physical and mental health condition, failed to provide the needed medical/mental care and failed to provide or maintain regular observations.

The plaintiffs request a trial by jury and seek compensatory and punitive damages, attorneys’ fees, costs of suit and all further relief the Court deems just and appropriate. They are represented by Stephen E. Walsh of Walsh & Walsh LLC in Poplar Bluff.
