SEMCO Plastics accused of failing to pay commission as agreed

ST. LOUIS — A former national sales manager is suing a custom plastic manufacturer for alleged breach of contract by failing to pay commission salary basis.

Matthew Wasiak filed a complaint in the St. Louis 22nd Judicial Circuit Court against SEMCO Plastics Co. alleging that the custom plastic manufacturer violated the Missouri Merchandising Practices Act.

According to the complaint, the plaintiff alleges that between May 7, 2012, and Sept. 28, 2016, he entered into a written employment agreement with the defendant, which said that he would receive a 4 percent commission of the sales receipts for new sales. The plaintiff claims he has made numerous new sales but has not received commission since May 2012. 

The plaintiff holds SEMCO Plastics responsible because the defendant allegedly denied plaintiff the representation, expectations and benefits expressed in the sales commission terms contained in the employment agreement.

The plaintiff seeks judgment for compensatory damages in an amount in excess of $350,000 plus interest, and for all such other relief as the court deems, just and proper. He is represented by Jill A. Silverstein of Jill A. Silverstein, Attorney at Law PC in St. Louis.
