Former employee accuses Weissman's Theatrical Supplies of discrimination, wrongful termination

ST. LOUIS — A St. Louis woman is suing an apparel and accessories manufacturer, citing alleged disability discrimination and wrongful termination.

Linda Hermann filed a complaint in the St. Louis 22nd Judicial Circuit Court against Weissman's Theatrical Supplies Inc., alleging that the defendant violated of the American with Disabilities Act (ADA) and Family and Medical Leave Act (FMLA).

According to the complaint, the plaintiff alleges that between 2010 and April 6, 2016, while employed at Weissman's returns department, she filed an application for FMLA leave due to a broken leg from a fall caused by high blood pressure. When she returned to work, the plaintiff was informed that she was being terminated due to cutbacks/downsizing but claims she was terminated because of her injury and high blood pressure diagnosis. 

The plaintiff holds Weissman's responsible because the defendant allegedly terminated the plaintiff due to her medical disability and fired her for exercising her rights in filing for medical leave.

The plaintiff requests a trial by jury and seeks award for damages, nominal and punitive damages in an amount in excess of $25,000 for attorneys' fees, costs, interest and for such other and further relief deemed just and proper. She is represented by Katie M. Rhoten and Jeremy D. Hollingshead of Hollingshead & Dudley in St. Louis.
