CarShield says CarSure adopted deceptively similar trademark

ST. LOUIS — An automobile seller and service contracts company is suing another automobile service company, citing alleged trademark infringement and unfair competition.

NRRM LLC doing business as CarShield filed a complaint on June 14 in U.S. District Court for the Eastern District of Missouri against KingStar Holdings LLC and CarSure LLC, alleging that the defendants violated the Lanham Act.

According to the complaint, the plaintiff alleges that it markets and sells vehicle service contracts using the marks "CarShield" and "CarShield.com" and claims it has federal registrations for and common rights in those marks. Plaintiff alleges the defendant adopted its marks for the same marketing purpose under the name "CarSure" that bears an uncanny similarity to its "CarShield" marks. As a result, plaintiff claims it caused confusion among consumers resulting in loss of revenue and diminishment of its goodwill and reputation. 

The plaintiff holds KingStar Holdings and CarSure responsible because the defendants allegedly used similar marks to cause confusion and falsely suggest that the service contracts originate from or are sponsored or endorsed by plaintiff.

The plaintiff requests a trial by jury and seeks to be awarded all damages incurred, attorney's fees, pre- and post-judgment interest and such other and further relief as the court may deem just and proper. CarShield is represented by Jeffrey H. Kass of Lewis Brisbois Bisgaard and Smith LLP in Denver.
