Mother sues Metro for death of son who was dragged under bus

ST. LOUIS — The mother of a man who was killed by a Metro bus is suing the Bi-State Development Agency, alleging negligence by the agency and its bus driver.

Nancy Floyd, mother of Keary Joyner, deceased, filed a complaint on June 12 in St. Louis 22nd Judicial Circuit Court against Terence Nash and Bi-State Development Agency of Missouri/Illinois Metropolitan District (doing business as Metro), alleging that the defendants failed to exercise the highest degree of care toward passengers boarding a bus.

According to the complaint, the plaintiff alleges that, on April 28, 2015, Joyner attempted to board the defendants' bus but was dragged under the bus for nearly a block, resulting in fatal injuries. As a result, Floyd suffered loss of companionship of her son and incurred funeral expenses. 

The plaintiff holds the defendants responsible because the defendant bus driver Nash allegedly drove the bus without utilizing the side mirrors to ensure that no persons were attempting to board the bus, drove too fast for road conditions and failed to warn the decedent that he was about to drive the bus forward.

The plaintiff requests a trial by jury and seeks judgment in excess of $25,000 together with costs and such other and further relief as the court deems appropriate. She is represented by Michael P. Glisson and Timothy J. Chartrand of Williamson, Webster, Falb and Glisson in Alton, Illinois.
