Man working on barge on Mississippi says he was injured in tugboat collision

ST. LOUIS — A Jefferson County man is suing an agricultural conglomerate and a river transportation provider, alleging negligence.

Nicholas Peters filed a complaint on June 1 in St. Louis 22nd Judicial Circuit Court against Archer Daniels Midland Company and American River Transportation Co. LLC alleging that the defendants failed to use ordinary care to provide employees with a reasonably safe place to work.

The plaintiff worked as a technician on a barge in the defendant's harbor area, where a tugboat operated by American River Transportation was employed by Archer Daniels Midland for transportation of goods on the Mississippi River in St. Louis. The plaintiff alleges that, on June 2, 2014, while working on the barge, plaintiff's barge was bumped by a pilot driving the tugboat, causing plaintiff to suddenly lose balance and injure his left knee. As a result, Peters claims he sustained severe injuries that resulted in disability, loss of earning capacity and expenses for necessary medical care and treatment. 

The plaintiff holds defendants responsible because they allegedly failed to reasonably train the pilot to operate the tugboat in a safe and suitable manner and failed to supervise the pilot of the tugboat.

The plaintiff requests a trial by jury and seeks judgment for an amount which is fair and reasonable under the circumstances, together with costs of suit and such other and further relief as the court deems just and proper. He is represented by Bradley M. Lakin of SL Chapman LLC in St. Louis.
