St. Peters woman accuses Ally Financial of telephone harassment over alleged debt

ST. LOUIS — A St. Peters resident is suing a financial company, citing alleged violation of telephone harassment statutes.

Elaine Riazi filed a complaint June 16 in the U.S. District Court for the Eastern District of Missouri Eastern Division against Ally Financial Inc. alleging that the defendant violated Telephone Consumer Protection Act (TCPA).

According to the complaint, the plaintiff alleges that on June 29, 2016, she instructed the defendant to stop calling her cellphone and withdrew any prior consent to receive an automatic telephone dialing system calls on her phone. Despite her request, the plaintiff claims she still received about 200 calls from the defendant's automatic dialing system. 

The plaintiff holds Ally Financial responsible because the defendant allegedly continued to call the plaintiff to collect a debt despite her withdrawal of prior consent, placed these calls under its own free will and willfully used an automatic telephone dialing system to place the unwanted calls.

The plaintiff seeks judgement for statutory damages, all our costs, witness fees, other fees incurred and other relief that the court deems appropriate. She is represented by Adam T. Hill of Krohn & Moss LTD in Chicago.
