Gateway Digestive and Liver Center claims construction company failed to pay subcontractors

ST. LOUIS — A St. Louis company is suing a construction company, citing alleged breach of contract due to failure to complete work.

Gateway Digestive and Liver Center LLC filed a complaint in the St. Louis 22nd Judicial Circuit Court against CJ Construction LLC, Jimmy Lee Cole and Cathy Micheline Rollins alleging that the defendants failed to meet their obligations under the construction agreement.

According to the complaint, the plaintiff alleges that on Dec. 8, 2011, it entered into a general contract agreement with the defendants to perform general construction for its clinic and surgical center. Pursuant to the agreement, the defendants hired several subcontractors and made lien wavers submitted to PNC Bank. When work was completed and funds were released, the subcontractors failed to receive payment for the work performed. 

The plaintiff also claims that the construction was not completed. As a result, Gateway suffered extensive lost profits due to delays. 

The plaintiff holds the defendants responsible because they allegedly failed to pay the subcontractors from the funds released by PNC Bank, failed to complete the work required under the agreement and refused to return the funds despite the fact that work has been substantially completed.

The plaintiff requests seeks judgment in the amount of $350,000, plus interest, costs of collection, attorneys' fees and for such other and further relief as the court deems just and reasonable. It is represented by Mindy K. Mahn of Central Plank LLC in St. Louis.
