Woman claims Lou Fusz Automotive Network ended her employment due to son's medical expenses

ST. LOUIS — A St. Charles County fleet leasing agent is suing a car dealer, citing alleged wrongful termination.

Lisa Johnson filed a complaint July 3 in the U.S. District Court for the Eastern District of Missouri Eastern Division against Lou Fusz Automotive Network Inc. alleging that the defendant violated the Employee Retirement Income Security Act (ERISA).

According to the complaint, the plaintiff alleges that in 2006, her 12-year-old son suffered a brain hemorrhage caused by cerebral arteriovenous malformation. The plaintiff claims that her son had health insurance coverage through her employer until termination from her employment Jan. 24, 2013. The plaintiff allegedly was terminated from her position due to a cut in company employment costs in relation to her son's extensive medical expenses. 

The plaintiff holds Lou Fusz Automotive Network responsible because the defendant allegedly openly and directly discouraged and interfered with the plaintiff's ability to exercise her rights as a participant in the group health insurance plan and terminated the plaintiff so she would no longer be able to rely on the insurance policy provided to cover her son's medical expenses.

The plaintiff requests a trial by jury and seeks to award restitution in the form of back pay, other benefits of employment, with pre- and post-judgment interest, attorneys' fees, costs incurred, and other and further relief as the court deems just and proper.
