Regions Bank claims loan borrower failed to pay $25,000 promissory note

ST. LOUIS — An Alabama bank is suing a loan borrower and guarantors, citing alleged breach of contract by failing to pay the required obligations.

Regions Bank filed a complaint in the St. Louis 22nd Judicial Circuit Court against Frontenac Cleaners West End Inc., Laundry Dryer and Equipment Co. and Sheree T. Sodipo alleging that the defendants violated the agreement to make full and punctual payment.

According to the complaint, the plaintiff alleges that on Sept. 17, 2008, the defendant executed a promissory note in the original amount of $25,000 for the plaintiff in which the defendant will make payment as stated in the loan documents. The plaintiff claims it failed to receive payment amounting to $28,811.71 in principal, accrued interest and late fees as of June 13. 

The plaintiff holds the defendants responsible because they allegedly failed to make payments as required by the note and guaranties and failed to satisfy their respective obligations under the loan documents following notice of default.

The plaintiff seeks judgment in the amount of $28,811.71, plus accrued pre- and post-judgment interest, collection costs, attorney fees, expenses and other relief the court deems just. They are represented by Nicole Berkowitz of Baker, Donelson, Bearman Caldwell & Berkowitz PC in Memphis, Tennessee.
