St. Louis woman claims church failed to maintain its premises

ST. LOUIS — A church attendee is suing a property owner and operator, citing alleged failure to maintain premises.

Ruby Hicks of St. Louis filed a complaint July 13 in the St. Louis Circuit Court against The Lively Stone Church of God, Apostolic Faith Inc. alleging the defendant failed control its premises, resulting to injuries.

According to the complaint, the plaintiff alleges that on March 5, she attended a religious service at the defendant's premises. The plaintiff claims that while she was leaving the premises, she tripped on broken, uneven and loose concrete at the front of the premises and fell down on the concrete. As a result, Hicks claims she suffered physical injuries, discomfort and medical expenses. 

The plaintiff holds The Lively Stone Church of God, Apostolic Faith, Inc. responsible because the defendant allegedly failed to maintained premises to avoid the dangerous condition, failed to warn attendees of the dangerous condition and failed to use ordinary care to remove or remedy the dangerous condition.

The plaintiff requests a trial by jury and seeks judgment for compensatory damages in such amount as shall be found to be fair and reasonable, costs incurred and expended and for other relief as shall be appropriate in the circumstance. She is represented by Benjamin F. Westhoff of Sedey Harper Westhoff PC in St. Louis.
