Family claims State Farm failed to provide compensation after car was hit by driver who fled

ST. LOUIS — A driver and his passengers are suing an insurance company, citing alleged breach of contract.

Daniel Gabriel-Tehandon and Veronica A. Gabriel, as well as Armando D. Gabriel and Javier A. Gabriel, by and through their next friend and mother Veronica A. Gabriel, filed a complaint in the St. Louis Circuit Court against State Farm Fire and Casualty Co. alleging the defendant failed to provide injury coverage under the terms of the insurance contract.

According to the complaint, the plaintiffs allege that on July 15, 2016, Gabriel-Tehandon was driving while they were heading west on Manchester Road in St. Louis when they hit from behind. The driver who struck their vehicle fled the scene and remains unidentified, according to court records. The plaintiffs filed an uninsured motorist coverage claim with the defendant but allegedly failed to receive compensation for the damages despite performing all conditions under the terms the insurance contract. 

The plaintiffs hold State Farm Fire and Casualty Co. responsible because the defendant allegedly failed and refused to make payments in an amount sufficient to compensate properly for the injuries sustained.

The plaintiffs request a trial by jury and seek judgment for more than $25,000 together with costs and for further relief deemed necessary and just. They are represented by Christopher K. Geldmacher of Sauter, Sullivan LLC in St. Louis.
