Consumers sue Equifax over alleged misrepresented debt

ST. LOUIS — Consumers are suing a consumer reporting agency, citing alleged misrepresentation in debt collection.

William J. Hediger IV and John and Janes Does 1-100 filed a complaint July 14 in the U.S. District Court for the Eastern District of Missouri against Equifax alleging the defendant violated the Fair Credit Reporting Act (FCRA).

According to the complaint, on Nov. 30, 2016, Hediger applied for a small-business loan order but was denied due to a previous debt that he claims was not under his name. He claims he has never done business with or had an account with the Metropolitan St. Lewis District. The error in his credit report resulted in significantly lowered credit score, denial of credit and less favorable interest rates, the complaint states. 

The plaintiffs hold Equifax responsible because the defendant allegedly continues to use an automated process to match court records with consumers’ credit bureau reports without having adequate policies and procedures in place to ensure accuracy and failed to comply with the requirements imposed on a consumer reporting agency.

The plaintiffs request a trial by jury and seek statutory and actual damages, attorneys' fees, costs, pre and post-judgment interest, and such other relief as the Court deems just and proper. They are represented by Boris E. Graypel of The Law Office of Boris E. Graypel LLC in St. Louis.
