New Vision Contracting LLC accused of violating employee benefits plan

ST. LOUIS — Trustees of a labor group are suing a joint-stock contracting company, citing alleged violation of an employee benefits plan.

Greater St. Louis Construction Laborers Welfare Fund, Brandon Flinn, Danny Jenkins, et al. filed a complaint on July 17 in the U.S. District Court for the Eastern District of Missouri against New Vision Contracting LLC, alleging that the defendant violated the Employee Retirement Income Security Act of 1974 (ERISA).

According to the complaint, the plaintiffs allege that they failed to receive accurate and timely monthly reports to the employee benefit funds employees despite reportedly being employees who were bound by a collective bargaining agreement between the parties. The plaintiffs also claim that they were not permitted to perform financial examination of the defendant's books and records to determine the amount of contributions. 

The plaintiffs holds the defendant responsible for allegedly refusing to submit monthly report forms for the periods from April 1 to April 30 or from May 1 to May 31.

The plaintiffs request a trial by jury and seek for an interlocutory order to submit reports and audit, award for interest, liquidated damages, costs, accounting fees, attorneys' fees and for such and further relief as the court may consider appropriate.
