Urban Services Group Inc. accused of violating workers' compensation acts

ST. LOUIS — A former employee is suing a supervisor and contractor company, citing alleged violation of workers' compensation acts.

Richard Mihalich filed a complaint on July 19 in the St. Louis 22nd Judicial Circuit Court against Urban Services Group Inc. and Robert Wagenseller, alleging that the defendants violated the Missouri Human Rights Act.

According to the complaint, the plaintiff alleges that he injured his right wrist and his neck while re-installing a light on Aug. 4, 2015. He reportedly was given a workers' compensation claim program and was advised by doctors to do light duty work. 

Upon his return to work, he allegedly was required to work that violates his doctor's work restriction and refused each time. On Jan. 8, 2016, the plaintiff reportedly was called into a meeting and terminated shortly after. He was replaced by a much younger employee who was not disabled. 

The plaintiff holds the defendant responsible for allegedly failing to provide possible accommodations for the plaintiff's injury, failing to engage in the interactive process to determine if it could accommodate a plaintiff in a different way and terminated allegedly terminating him due to his disability and age.

The plaintiff requests a trial by jury and seeks judgment for damages, including lost wages and other benefits, compensatory and punitive damages, pre-judgment interest, front pay and for such additional relief that may be just.
